For this U.S. based position, the expected compensation range is $228,000 - $343,000 per year, which includes base pay and short-term incentive.
The compensation range for this full-time position applies to candidates located within the United States. Our salary ranges are determined by reviewing roles of similar responsibility and level. Within the salary range, individual pay is determined by several factors including performance, knowledge, job-related skills, experience, and relevant education or training. As the lead of Schneider Electric Standards Essential Patent Strategy, you will join a talented and collaborative global group of in-house lawyers and legal professionals to support the global Intellectual Property legal strategy and risk mitigation work for Schneider Electric and its group companies. This role will report to the Associate General Counsel, Global Litigation and Risk Management or the Chief IP Counsel.
Responsibility:
• Develop and implement global Standard Essential Patent (SEP) strategies in a dynamic and changing marketplace to mitigate IP risk and provide legal guidance and support for global SEP risk, licensing, and development and other strategic activities;
• Independently negotiate complex SEP licenses and pools, both inbound and outbound;
• Develop strategy and business operations for risk assessment and royalty processes for SEP implementation in a dynamic and changing marketplace;
• Partner with global supply chain management and procurement to develop price comparison for SEP indemnification and risk assessment;
• Develop business plan and strategy for SEP portfolio acquisition, maintenance, and exploitation including budget and business support.
• Develop and maintain claim chart database and develop strategy for SEP claim chart scope and coverage;
• Collaborate with the branches of IP Team, Global Legal, external counsel, and service providers as necessary for legal and technical support;
• Ensure compliance with relevant Intellectual Property laws, competition/anti-trust laws, regulations, and internal policies;
• Stay up-to-date on legal and regulatory developments in the Intellectual Property field and advise the organization accordingly; Collaborate on development and implementation of Schneider Electric government policy strategy related to SEPs;
• Providing other assistance and support to the business, Finance, M&A, R&D, marketing, and legal department teams as required, including on pre-litigation and litigation matters.
Qualification Requirements:
• 15+ years experience negotiating SEP licenses;
• Fluency/proficiency in English (oral & written);
• Strong knowledge of local and global SEP laws, competition/anti-trust laws, regulations, and court precedent;
• Strong knowledge of SEP royalty rate determination and Fair, Reasonable, and Nondiscriminatory (FRAND) analysis and requirements in multiple SEPs including 3GPP cellular standards, IEEE 802.11 WiFi standards, and Zigbee.
• Proven track record of negotiating SEP agreements, and providing advice and support on all sorts of SEP matters;
• Demonstrated technical expertise in multiple SEPs including 3GPP cellular standards, IEEE 802.11 WiFi standards, and Zigbee.
• Proven track record of building royalty payment estimation and payment structure in collaboration with business, sales, and finance departments in multiple SEPs including 3GPP cellular standards, IEEE 802.11 WiFi standards, and Zigbee.
• Proven track record of SEP portfolio development and risk mitigation in IEC IEC 61851-1, Connectivity Standards Alliance Zigbee, Sercos and others.
• Excellent negotiation, and communication skills.
• Excellent budgeting estimation and compliance skills.
Preferred:
• Qualified lawyer with at least 15 years of experience in Intellectual Property law, preferably in-house or at a reputable law firm;
• Member of Licensing Executive Society (LES)
• Professional experience in both private practice and in-house multinational environments;
• Demonstrated ability to develop and implement policies and standards;
• Demonstrated ability to direct and manage external counsel and vendors within a budget; and
• Working knowledge of a language other than English (Chinese, French, German or Spanish - a plus).

• Strong organizational and project management skills with an attention to detail;
• Ability to work on own initiative, independently and collaboratively with cross-functional teams;
• Strong analytic skills to identify risk, evaluate associated risk mitigation actions and clearly summarize complex topics and needs;
